CHQ writes to CMD requesting filling up the vacant posts of SDE(Telecom) on urgent basis :

'Even after issuing above mentioned promotion orders for 3697 JTOs of AIEL no. 1 and 2, more than 1200 JTOs of AIEL number 2 (of recruitment year 2008) are still waiting to get their first promotion orders. These JTOs of Recruitment Year 2008 are very much frustrated because even after availability of sufficient number of vacancies these executives have not got promotion while some of their colleagues have already been promoted. We therefore request you to kindly look into the matter and issue necessary instruction for conducting a DPC for remaining JTOs of AIEL number 2, so that these JTOs of recruitment year 2008 can also get their first promotion and join their colleagues in SDE cadre.'  Read More

CHQ writes to CGM Kolkata Telephones on the harassment of executives, both retired and serving by CTD, wrongly interpreting BSNL order dated 22.12.2015 and ordering recovery of huge amount:

Now, BSNL Corporate Office once again clarified vide letter No.5-21/2021/ESTT-IV/CPGRAMS/240/9 dated 16.2.2021 to CTD in reply of CPGRAMS docket no DOPPW/E/2020/24019 wherein it is mentioned "the method of pay fixation made by CTD is not correct in para 3 of the letter".   Read More

CHQ writes to Director (F) on Irrational act by CTD administration in refusing to implement BSNL clarification on Pay fixation of officiating JTOs who were promoted in the year 2008 and opted for Pay fixation in revised scale from the date of their promotion as regular JTO:

'But CTD administration reportedly insists that refixation was done as per BSNL order dated 22.12.2015 as clarified under a) and therefore there is no need to change it and that now recovery will be ordered. Our Circle Association met PGM (F) on 9.11.2020 and explained to her that clarification under a) is applicable only for those who were promoted after 07.05.2010 and clarifications under b) and c) are applicable for those who were promoted during the period 01.01.2007 to 07.05.2010. CHQ writes to CMD again on Harassment of the Executives, both retired and serving, by Calcutta Telephones, wrongly Interpreting BSNL letter No.5-32/2013/Estt.IV dated 22.12.2015 and ordering for recovery of huge amount:

'In our letter we had raised two important arguments, questioning the wrong action of Calcutta Telephones. Factually, the BSNL letter No. 5-32/2013/Estt.IV dated 22.12.2015, pertains to the issue of fixation of Pay of officiating JTOs under FR 22 1(a) (i) and reversion before sending them for Phase I training. This Order clearly mentioned at serial No. 1 regarding reversion of officiating JTOs under new scheme and syllabus.'   Read More

'We, therefore, request that the election may be deferred till the country is free from COVID-19 risk, public transport is restored in the entire country and the other poll processes can be followed in accordance with the Election Commission guidelines or at least in accordance with the procedures which were followed in the first membership verification of Executive Associations in BSNL. 'The said order BSNL No.1-16/2010-PAT(BSNL) dated 7.5.2010, based on which the pay of these TTAs and other non-executives were fixed in the revised scale on the date of their regular promotion as JTO, has neither been withdrawn nor has been superseded till date. '   Read More

'We would therefore request you to kindly intervene and cause advice to BSNL Management not to violate the MHA guidelines on COVID-19 containment and also not to put the lives of its employees at risk. 'Therefore, the present BSNL order No. BSNL/Admn.1/15-12/18 dated 8.5.2020 fixing the ceiling with Basic Pay + DA on date of retirement, contravenes the BSNL order dated 8.9.2010 issued with the approval of the BSNL Board.'   Read More

CHQ writes to CMD BSNL regarding Harassment of Executives and retired executives by CTD administration, wrongly interpreting BSNL letter No.5-32/2013/Estt.IV dated 22.12.2015:

'Vide BSNL letter No.5-32/2013/Estt.IV dated 22.12.2015, instructions were issued regarding fixation of pay of officiating JTOs under FR 22 1 (a) (i) and reversion before sending them for Phase I training. This order pertains to screening test qualified TTAs officiating as JTO and covered by JTO Recruitment Rules 2014. Earlier, vide BSNL letter No.5-20/2015/Estt.IV/RR2014 dated 20.11.2015, instructions had been issued for sending these officiating JTOs to Phase I training directly (without reversion). The letter dated 22.12.2015 clearly mentions that it supersedes the letter dated 20.11.2015 pertaining to those covered by JTO RR 2014.'   Read More

CHQ writes to CMD BSNL requesting him to drop the idea of Second Membership verification of Executive Associations:

'We are grievously shocked over the BSNL letter cited under reference, notifying 2nd membership verification, at a time when BSNL is burning and not able to pay
(i) Salary of its employees regularly,
(ii) Medical bills to working as well as retired employees,
(iii) Electricity bills,
(iv) Vendor bills,
(v) Contract labour wages.
In addition to this, an amount deducted from the salary of employees, against their society loan, bank loan, insurance premia, GPF contribution, etc. has not been paid to respective co-operative societies, to banks, to LIC and even to DoT. And when the entire country is burning due to unforeseen COVID-19 crisis and in lockdown, fixing the date of election date as 18.8.2020, can only be called as a horrendous and atrocious decision.'   Read More

'We are sorry to say but by now it has become the practice of BSNL Management not to pay the salary of its employees in time. Once again, we, as a result of this, convey the deep disappointment and resentment in the minds of BSNL employees over non-payment of their salary for May 2020 till today. While, BSNL employees have been rendering unfailing telecom services during the lockdown, risking their lives, this attitude of the Management is quite appalling.'   Read More

'It needs to be understood that every employee who opted for VRS had taken a hard decision to severe ties with the organization he had been associated with for many decades, after conscious and laborious calculations of the ex-gratia he would receive and plans to cope up with the future, drawing less than half of the salary he had been drawing earlier, in the absence of payment of gratuity and commuted amount of pension. These VRS retirees are really anxious about receipt of the remaining 68.7% ex-gratia payment.'   Read More

'Health care benefits are of critical importance to most of the employees, both serving as well as retired. Ensuring wellness of the employees is one of the primary responsibilities of any Management. Non-payment of claims for reimbursement with voucher/without voucher and also for indoor treatment, for more than a year, has put the employees under severe financial and mental stress. 'Due to the extra-ordinary situation of continuous lockdown due to COVID-19, no retired employee, retaining the quarters, could move out. Reducing the ceiling to 15 days will adversely affect the serving employees as well as the retired employees, as the cost of outdoor treatment including cost of medicines growing alarmingly very high every year. Apart from this, the order itself appears to have been issued in a hurry, without considering the objective of rolling out the BSNL MRS and previous orders issued under the scheme and without any dialogue with the stakeholders.   Read More

'The reason attributed to the decision that exemption shall not be applicable to those taking voluntary retirement is that “Superannuation is a pre-defined point of time in the career of the employee, whereas the timing of voluntary retirement depends upon the choice of the employee who knows the pros and cons of his option before exercising it. While this argument may be correct in respect of those taking voluntary retirement under Rule 37 A (11A) of CCS (Pension) Rules 1972, it will not be correct in respect of those opting VRS under BSNL VRS 2019. In the latter case too, the employees do not have the choice of choosing the date of retirement which has been fixed as 31.1.2020.'   Read More

CHQ writes to Director HR on futility in calling for objections in seniority llist of TES Group B circulated vide BSNL letters dated 7.8.2018 & 8.8.2018:

We would like to draw attention to the fact that the said BSNL letter dated 8.8.2018, under Para 2 has clearly mentioned that “The Hon’ble Supreme Court has upheld the Seniority List as per Rule-2016 in its Judgment dated 14.12.2017. The Hon’ble Supreme Court in its Judgment states “The Judgment of this Court in (2015) 12 SCC 360 (Supra) will be treated as final between the parties on the principle of seniority.” Hence, in compliance of the Hon’ble Supreme Court Judgment dated 21.02.2015 and 14.12.2017 in Civil Appeal No(s) 4389 of 2010 Union of India & Ors Vs. Sohan Lal Sayal & Ors and connected Cas, Seniority List of TES Group B executives has been recast on the basis of qualifying examination (Rule 206).”   Read More

'BSNL may negotiate with Public Sector Insurance companies and Banks for providing the best insurance cover to BSNL employees for indoor and outdoor treatments. In this regard BSNL may call bids from all Public Sector Insurance companies and Banks and negotiation may be held with the L1 bidder. The best Group Medical Insurance Policy, which assures maximum possible insurance cover for both, indoor as well as outdoor treatments, with a special provision for increased cover in respect of critical illnesses, should be finalized. The policy should be available to BSNL retirees too.'   Read More

CHQ writes to Secretary DoE on Pension contribution by BSNL to the Government of India in respect of its employees permanently absorbed in BSNL:

We understand that the DoPT order dated 19.11.2009 limiting pension contribution to actual basic pay drawn, is a considered decision, based on the above principle and the fact that the VII CPC introduced Pay Matrix instead of the then existing Running Pay Band and Grade Pay system. For example, Grade Pay 1 to 5 comes under Pay Band 1 with Rs.5200-20200. As there is no possibility of any Government Servant on transfer to Foreign service to reach the maximum of the pay band, DoPT restricted the pension contribution to the actual pay drawn w.e.f. 1.1.2006, the date of implementation of Government decision on the recommendations of VII CPC.

In BSNL too, due to availability of time bound financial upgradations every 4 to 5 years, no one will reach the maximum of his present pay scale. Therefore, following the DoPT OM dated 19.11.2009 in respect of BSNL absorbed employees drawing IDA pay scales, is justified legally as well as rationally.   Read More

'For example, in Tamilnadu Circle, in the absence of any such understanding between BSNL and the Tamilnadu Electricity Board (TNEB), electricity has been disconnected for many exchanges and tower sites, affecting our mobile services and consequent loss of revenue. CHQ writes to CMD conveying concern regarding amendment issued to RR 2005 of Rajbasha Adhikari:

'As per the DO letters of Secretary, Department of Official Language and letters issued by Department of Telecom, similarity is required to be maintained in the pay scale and designation of AD (OL) across all offices. But BSNL has changed the designation of AD(OL)/ Rajbhasha Adhikari to Sub Divisional Engineer (OL), and also the mode of promotion to higher post i.e. Rajbhasha Adhikari. 'Our confidence is based on the fact that the affordability clause was very much there in the Government decisions on the recommendations of the 2nd PRC circulated vide DPE OM No.2(70)/08-DPE (WC) dated 26.11.2008, with the only difference that the 2nd PRC stipulated ‘not more than 20% dip in PBT for the year 2007-08’, and the 3rd PRC has stipulated ‘not more than 20% dip in PBT for the last three financial years preceding the year of implementation.’ The DPE OM dated 26.11.2008 for implementation of 2nd PRC recommendations had also provided for ‘a uniform lower fitment benefit of 10% or 20%, depending upon their affordability’. Even then Executives of MTNL were granted pay revision w.e.f. 1.1.2007 with the highest admissible fitment benefit of 30% despite MTNL incurring consecutive losses for several years before.'   Read More

'Moreover, DoT's concern about 'huge financial burden on Government Exchequer is far from any truth as there will be no additional financial implication either for BSNL or for the Government in upgrading the E3 to E6 scales as all would have crossed the minimum of the next higher scales and there will be no impact on pension too. The financial implication in replacing the E1A and E2A pay scales with E2 and E3 pay scales for JTOs & their equivalent cadres and SDEs & their equivalent cadres respectively is minimal and major portion of the additional cost estimated by BSNL will be Pension Contribution to be paid to the Government only. Although the latest committee had recommended time bound functional promotion every five years upto DE level, the Personnel section is said to have proposed to cap the number of DE/AGM posts. The Personnel section reportedly has recommended further tightening of benchmark in APAR. As suggested by the Deloitte Consultant and later modified based on the Heads Of Circles opinion, JTO, SDE and Sr.SDE cadres are proposed to be clubbed and asked to report to DE/AGM. Even before a decision is taken on the proposals, orders have been issued asking JTOs and SDEs to report to DE/AGM, which is going to have disastrous impact on hierarchy management.'   Read More

'When the revised pay scales were implemented for BSNL Executives on the basis of Government decisions on Second PRC, E6 scale was not offered to any cadre/grade in BSNL. AIBSNLOA had therefore suggested “review of the issue dispassionately and grant of following IDA pay scales to the Executives from JTOs level to Dy GMs : (a) JTOs level : E-2 scale, (b) SDEs level : E-3 scale, (c) Sr SDEs/Sr AOs : E-4 scale, (d) DEs level : E-5 scale and (e) DGMs level : E-6 scale.'...'Had E6 scale been given to JAG grade, SG JAG grade would have got E7 scale. Today, a discrepancy exists wherein Group B absorbees are fitted in E6 scale for SG JAG, while those absorbed as Group A have been given E7 scale for SG JAG.'...'Finally, it is learnt that, there is an indication by the Management side that resolving of these issues may not be retrospective in nature. We are in complete disagreement with such a notion since, at the time of pay revision w.e.f. 1.1.2007, BSNL orders dated 5.3.2009, while tabulating revised pay scales effective from 01.01.2007 for other cadres, did not mention any pay scale for the pre-revised scales of 9850-250-14600 (E1 A) and 11875-300-17275 (E2A) for JTOs and SDEs and equivalent cadres, but left a foot note that revised IDA scales for E1 A and E2 A will be notified later. Therefore, any revised scale that will be decided now should be effective from 1.1.2007 only. Denial of arrears will be against all norms and legal prudence since it is BSNL who delayed the notification unduly for more than six years and the executives cannot be allowed to suffer on this count.' Work load on these executives in the field units has been phenomenally increasing, since there has been huge number of retirements during the recent past and the sections handled by them are given to those in service as additional charge with no limit prescribed for such additional charges. 'It may kindly be recalled that the NDA Government had assured at the time of formation of BSNL in October 2000 that BSNL will be compensated for any loss making services in remote and rural areas and the financial viability of BSNL will be ensured through ADC, reimbursement of licence fee and support through USO fund. After a few years, the UPA government had stopped all these financial assistances, except support through USO Fund. 'The DoT on its part had committed, in the MoU between DoT and BSNL for 2012-13 signed on 14.3.2012, for refund of upfront BWA spectrum License fee. It has taken more than a year and a half for DoT to get a recommendation by a GoM for refund of Rs 6,724.51 crore. 'These guidelines are clear violation of the DoP&AR O.M. No. No.1/3/69-Estt(D) dated 22nd November, 1975 stipulating the Policy to be followed in case where persons refuse promotion to a higher grade. According to this O.M., no fresh offer of appointment on promotion should be made in such cases for a period of six months from the date of refusal of first promotion and this policy will not apply where adhoc promotions against short-term vacancies are refused.'  Read More
