CHQ submits its views to the Committee constituted to examine the demand for parity in pay of post-2007 recruited executives with pre-2007 executives:

17.01.2017:

CHQ writes to Sr. General Manager (Pers) requesting promotion to DE/AGM grade - left out executives from seniority lists 3, 4 and 5:

'We therefore request that a CPC may be held to promote these left out executives whose names are in Seniority List 5 and therefore is not the subject of any pending court case. Since these CPCs were held fulfilling the requirement for reservation at that time, there will not be any need for fresh reservation. While this move will help BSNL in augmenting operational efficiency by filling up vacant posts, the concerned Executives also will feel contented at the fag end of their service.'   Read More

CHQ writes to Director (HR) regarding Transfer of SDEs/ DE from RTTC Chennai to Chengelpattu SSA under local tenure transfer before completion of tenure in RTTC In Chennai Telephones District:

'We would like to reiterate our position that routine transfers within Circle, whether tenure or otherwise should not include faculty in RTTC since they are selected by a DSC, for a period of five years. The officers selected and posted as training centre faculty are not permitted to give request transfers without completing their tenure and are not given a chance to officiate in a higher post outside the training centre. This being the case, it is not fair to consider them for transfer outside the training centre based on their longstanding service in the circle in which the RTTC falls. Of course, they cannot claim immunity from All India transfer since they are also not denied any promotion on All India basis because they are under tenure in a training centre.'   Read More

CHQ writes to Director (HR) requesting speedy action to get early decision from Ernakulam High Court:

'While everyone was attributing the delay in finalisation of court case to lethargy and lack of seriousness of legal cell, recently it has been established that our legal machinery is quite capable of speedy action in court cases, by submission of counters and rejoinders in time, by engaging senior counsels and even by deputing the Addl. 20.12.2016:

CHQ writes to CMD BSNL Replacement of E1A and E2A pay scales as assured in the Pay Revision order issued on 5.3.2009 – Rationale behind BSNL Proposal submitted to DoT and unfounded apprehensions of DoT regarding financial implications :

'We are very much concerned about the observations of AST DoT during a meeting with Unions and Associations in BSNL on 13.12.2016, that DoT proposes to move a cabinet note for having replacement scales equivalent to E1A and E2A pay scales which existed prior to pay revision w.e.f. 1.1.2007 and that when the incumbents move out, recruitment will be made to fill the vacancies in E1 scale only. We understand that this was based on his discussion with one of the BSNL Executive Associations wherein the association had mentioned that E1A and E2A pay scales were given as part of a settlement and that the present situation has arisen because DoT did not approve it.'   Read More

CHQ writes to Director (HR) requesting Consideration of transfer requests of DEs who have completed two years in the circles :

'We shall be thankful if all the requests pending with Personnel Section are considered at the earliest and transfer orders issued at the earliest, so as to give relief to the executives who have remained away from their families for the two years, obeying the orders of Corporate Office.'   Read More

CHQ writes to CMD requesting early action to hold DPC for promotion to various grades:

'Therefore, action needs to be initiated for holding of DPCs for promotion to various grades, where there is no stay on promotion in currency in any court. If at all any court direction is at variance with the existing DoP&T instructions, action to get the court direction stayed/modified by higher courts has to be taken immediately without any delay.'   Read More

CHQ writes to GM (Estt) regarding Discrepancy in method of calculation for refixation of pay with 78.2% fitment benefit:

'It has been brought to our notice that in the Revised Pay fixation table with 78.2% IDA under Annexure of the letter cited under Reference 1 above, under Grade E3, the revised pay for Rs.14750 (with 78.2% IDA) has been shown as Rs.34170, which should have been Rs.34180 in accordance with the fixation method mentioned in letter cited under Reference 2 above.'   Read More

CHQ writes to Director (HR) in response to Personnel Section proposal on CPSU Cadre Hierarchy:

'We therefore request you to kindly cause modification of the proposal by removing the complexities, the added stringent attendant conditions, capping the number of posts of AGM and by allowing Seniority Cum Fitness method of promotion upto SAG level. The concept of giving designation, status and financial powers for Executives in higher scales but not occupying the posts may be introduced without giving room for ambiguity.'   Read More

CHQ writes to CMD requesting Payment of ex-gratia amount in lieu of bonus:

'It is a known fact now that under your Chairmanship, promising signs of revival of BSNL are already there with improvement in the revenue and picking up of sales with the SWAS programme. A small positive gesture at this time by the Management will greatly improve the morale of the employees and result in further growth.'   Read More

10.09.2016:

CHQ writes to General Manager (SR) regarding delay in finalisation of electoral rolls:

'According to reports received by us, even the display of electoral rolls has not been done in some circles till 5.9.2016. The Associations should be given time to submit their objections, if any, afterwards and the electoral rolls will have to be revised accordingly. Then only final lists can be displayed.'   Read More

22.08.2016:

CHQ writes to MOC on DoT’s irrational action in rejecting BSNL proposal to remove aberrations in non-standard pay scales as directed by DPE:

'Moreover, DoT's concern about 'huge financial burden on Government Exchequer is far from any truth as there will be no additional financial implication either for BSNL or for the Government in upgrading the E3 to E6 scales as all would have crossed the minimum of the next higher scales and there will be no impact on pension too. The financial implication in replacing the E1A and E2A pay scales with E2 and E3 pay scales for JTOs & their equivalent cadres and SDEs & their equivalent cadres respectively is minimal and major portion of the additional cost estimated by BSNL will be Pension Contribution to be paid to the Government only. But this small gesture will benefit BSNL by providing an atmosphere to retain the services of young new entrants and ensure that they are not forced to migrate to other organisations in search of higher emoluments. In fact, because of the delay by BSNL in taking a decision on the issue, during the past seven years, many JTOs have already left BSNL opting for even other PSUs having one level higher pay scales.'   Read More

CHQ writes to Director (HR) in response to the appeal and advisory BSNL officers and executives:

'But it may not be out of context to say here that no officer or executive will intentionally take a decision to seek legal remedy, given the cost, time and mental agony connected with it. No one will file a case just for the fun of it. If the cases are properly analysed, in most of the cases the concerned Executives would have been really aggrieved either by his genuine plea not being accepted or by arbitrary, and deliberate violations of BSNL Transfer Policy by the Circle and SSA administrations.'   Read More

CHQ writes to Sr.General Manager (Pers) requesting promotion to DGM (T) on regular basis:

'Although it was agreed that the matter will be considered positively, no promotion to DGM (T) grade on regular basis has been ordered even after lapse of four months. A few of the adhoc DGMs (T) have retired during the period and more will be retiring every month. This is causing frustration and unrest among the executives of the grade.'   Read More

12.07.2016:

CHQ writes to CMD requesting to consider those were seniors prior to the pronouncements of Hon’ble Supreme Court of India in C.A.4389/2010 for promotion to DGM (T) on adhoc basis:

'After pronouncements of Hon’ble Supreme Court of India in C.A.4389/2010, the seniority lists have been revised (Provisionally) and as a consequence they have become junior and may not be under consideration for promotion to DGM (T) on adhoc basis for the remaining number of vacancies which are yet to be filled up. Once these vacancies are filled up they will also loose the opportunity to ‘look-after’ the duties of DGM (T). This will lead to an embarrassing situation where they will have to work as STS under those who were previously their juniors and worked under them. This will adversely affect the morale of these executives.'   Read More

CHQ writes to requesting all facilities to Executives Looking After higher posts:

'While these executives are shouldering the responsibilities of the higher post with administrative and financial powers, they are being denied the facilities attached to the higher post like higher rate for mobile handsets, briefcase, eligibility for department vehicle etc. This results in discrimination between regularly promoted executives and those doing the same work on ‘Look After arrangement’ and is a cause for resentment.'   Read More

CHQ writes to CMD requesting grant of status and powers of SDE to all the executives who are already in E2 scale and above but not yet promoted as SDE:

'The company, as it seems, is not serious in bringing the court cases to an end, since it has been able to put the responsibility on the JTOs and extract the work of SDE from them without hindrance of work in the name of Looking After promotion. Even transfers are being forced on them in the name of Looking After promotion, justifying the transfer on the ground that they are already drawing the SDE scale and hence cannot deny LA promotion.'   Read More

CHQ writes to CMD regarding Formation of Joint committees with officers representing Management as well as representatives from Executives Associations – resolving of issues of E2, E3 scales, CPSU Cadre Hierarchy etc:

'Now, the associations which were part of the joint committee have launched agitation programmes separately, two of them questioning their own recommendations made through the committee. After a meeting with these associations on 11.5.2016, Director (HR) has issued an appeal, wherein it has been stated that another Joint Committee will be formed to look into the issues out of implementation of the modified structure of CPSU cadre hierarchy based on discussion with top Management.'   Read More

BSNL replies to AIBSNLOA CHQ request to remove discrimination in grant of JAG selection grade scale to absorbed BSNL Executives:

In reply to CHQ request to remove discrimination in grant of JAG selection grade scale to absorbed BSNL Executives, BSNL CO has stated that JAG NFSG is applicable only to those officers who have achieved DGM grade substantively. This scale cannot be prescribed for officers who do not attain DGM grade and get the benefit of higher scale only through Time Bound Financial Upgradation.   View BSNL letter

CHQ writes to CMD BSNL regarding Promotion to DGM (T) on adhoc basis – purely based on seniority as per the pronouncements of Hon’ble Supreme Court of India in C.A.4389/2010 :

'In this regard, we would like to draw your kind attention to a DoP&T order No.14017/12/88- Estt.(RR) dated 25.3.1996 which stipulates that, “Where juniors who have completed their qualifying/eligibility service are being considered for promotion, their seniors also be considered provided they are not short of the required qualifying/eligibility service by more than half of such qualifying/eligibility service or two years whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/eligibility service.”'   Read More

CHQ writes to CMD BSNL regarding Plight of candidates who appeared for JAO LICE in 2012 against 40% quota – case of candidates from Kerala Circle:

'We request that the whole issue be considered on the grounds that these candidates will be subjected to irreparable loss in case the Hon'ble Supreme Court decision favours appointment of these candidates, at a later date. On the other hand, the CAT order has provided a safeguard, by directing the applicants to submit an undertaking that if the Hon'ble Supreme Court in the pending SLPs decides against the interest of the applicants and as a consequent of the same if any amount becomes refundable, the applicants will refund the same to BSNL.'   Read More

'Transport Allowance payable to BSNL Executives was last revised on 23.8.2006. During the past ten years petrol price have been revised a hundred times with the present price almost 50% more than the price in the year 2006.'   Read More

CHQ writes to Director (HR) regarding Review of tenure period and related facilities i.r.o. Udhampur and Rajouri SSAs of J&K Circle – applicability for those completing the revised tenure:

'We feel that it is unjust to deny the benefit of revised tenure to those executives already serving in these SSAs, when the order dated 19.2.2016 itself does not say that the order takes effect from the date of issue. Even if it is to be implemented from 19.2.2016, the benefit of revised tenure cannot be denied to those executives who are already working in these SSAs and completing the revised tenure on or after 19.2.2016.'   Read More

CHQ writes to GM (Estt) regarding LICE for promotion to JTO grade - Condoning shortfall in qualifying senrice period :

'In the year 2OO8, around 320 TTAs were recruited in Tamilnadu and were sent for training in different batches starting from 02.06.2008 to 01.09.2008. 180 TTAs had their training commenced in June 2OO8 and the remaining 14O TTAs were given training after June 2008. As a result, the latter 140 TTAs do not have the prescribed qualifying Jervice for appearing in the said LICE.'   Read More

CHQ writes to Director (HR) on CPSU CADRE HIERARCHY:

'It is learnt that these proposals, if implemented, will double the wait period in getting the first promotion and it will take minimum 17 years to reach DE scale. Although the latest committee had recommended time bound functional promotion every five years upto DE level, the Personnel section is said to have proposed to cap the number of DE/AGM posts. The Personnel section reportedly has recommended further tightening of benchmark in APAR. As suggested by the Deloitte Consultant and later modified based on the Heads Of Circles opinion, JTO, SDE and Sr.SDE cadres are proposed to be clubbed and asked to report to DE/AGM. Even before a decision is taken on the proposals, orders have been issued asking JTOs and SDEs to report to DE/AGM, which is going to have disastrous impact on hierarchy management.'   Read More

CHQ writes to CMD on Promotion to DGM (T) on adhoc basis – purely based on seniority as per the pronouncements of Hon’ble Supreme Court of India in C.A.4389/2010 :

'The DEs/AGMs who are under consideration for promotion to DGM (T) grade now were promoted to the STS grade based on the then applicable seniority list, which has been modified now as per the directions of Supreme Court. Some of them may not have the required qualifying service of 4 years in STS grade while their juniors (according to revised seniority) promoted earlier to them as STS will have the qualifying service. Promoting these juniors, leaving out the seniors according to the restored seniority lists 1 to 17 will result in a serious discrepancy.'   Read More

'While the committee had accepted one of our demands viz. revision of pay scale of Rajbasha Adhikari to SDE scale, it did not agree for augmentation of Rajbasha Adhikari posts. Since then, the Establishment Section was said to be processing the issue of revision of pay scale of Rajbash Adhikari. CHQ writes to Prime Minister requesting complete rollback of proposal to tax 60% of EPF corpus at the time of withdrawal:

'The proposal to tax 60% of EPF corpus at the time of withdrawal has therefore come as a bolt from the blue for these employees. A rough estimate shows that these employees will lose nearly 20% of their retirement savings.'   Read More

'All the remaining, around 90 DGMs, have completed more than three years of service in the grade. Sufficient number of vacancies are also available to promote these remaining DGMs (T) on regular basis.'   Read More

CHQ writes to Sr. GM (Pers) on Inter-circle transfers in DE/AGM grade:

'The previous practice of issuing transfer orders as and when requests are received was therefore helpful since the Executives were able to get relieved atleast a few months after their completing two years/tenure. According the new guidelines, transfer orders are to be issued every quarter in the first week of July/October/January/April. But non-adhering to its own guidelines by the Personnel Section, has put the [around hundred] Executives eagerly awaiting their transfer in utmost mental stress.'   Read More

'We are very much concerned about the reply of the DPE in respect of an issue referred to by PMO, since it is very elusive and does not precisely state when the committee will be constituted although it had said more than a year back that “the process of constituting 3rd Pay Revision Committee has been initiated.”'   Read More

CHQ writes to Prime Minister regarding REVISION OF BASIC PENSION WITH FITMENT BENEFIT OF MERGER OF 50% DA EFFECTIVELY AMOUNTING TO 78.2% DA – ABNORMAL DELAY IN SUBMISSION OF CABINET NOTE BY DOT:

'Since then, during the past 15 months, DoT has been dilly dallying with the issue and as a result the final Cabinet Note on the issue is yet to be submitted for the approval of the Union Cabinet. A bulk of BSNL pensioners who retired between 1.1.2007 and 9.6.2013 feel being ditched by the DoT which they had served for so many years.'   Read More

'We therefore request you to kindly advice the BW Section to dispose of the representations requesting second ACP also on the same analogr for promotion to EE grade as per BSNL MS RR 2009 so that the diploma holders with 10 years of experience get their second ACP without any further delay.'   Read More

CHQ writes to Director (HR) on EXEMPTION FROM APPEARING IN MANDATORY EXAMINATION ON FINANCIAL UPGRADATION IN RESPECT OF ALL PHYSICALLY CHALLENGED EXECUTVES :

'During our scheduled meeting on 15.12.2015, we had raised the above issue and had requested that orders may be issued empowering the Director (HR) to grant exemption to physically challenged executives from appearing in the mandatory examination. You had observed that exemption may be considered in case of those who are having disability of 4O%o and above and directed Sr. General Manager (Pers) to talk to the Circle Head in respect of a specific case referred to by us for recommending the case for exemption.'   Read More

Agenda of items to be discussed with Director (HR) in the scheduled meeting for January 2016:

CHQ had submitted the agenda of items to be discussed with Director (HR) in the meeting scheduled for 11.01.2016. But the same day BSNL CO had issued orders suspending scheduled meetings with all unions and associations with immediate effect. The suspension of scheduled meetings is reported to be in view of the impending membership verification election for non-executive unions in April 2016. CHQ writes to Prime Minister of India requesting Constitution of Third Pay Revision Committee for Executives of Central Public Sector Enterprises:

'PMO had responded (to our letter) by sending an I.D.Note on 14.10.2014 to the Department of Public Enterprises. Referring to our letter to Prime Minister, the DPE in its communication W-09/0007/2014 DPE dated 5.12.2014, had informed us that the process of appointing 3rd Pay Revision Committee had commenced. But nearly after a year, constitution of the committee is yet to take place. Meanwhile the VII CPC has also submitted its report well before the date of implementation recommended by it – 1.1.2016.'   Read More

CHQ writes to Director (HR) regarding Extending the benefit of court decision to all – pay fixation under FR 22 (1) (a) (i) for TTAs officiating/officiated as JTOs:

'To end the anxiety of the affected officials/executives, we request that a common order can be issued extending the benefit of pay fixation under FR 22 (1)(a)(i) to all the officials/executives officiating/officiated as JTOs, after getting a declaration from them that this will be subject to the outcome of the appeal filed by BSNL and they agree for recall of the benefit and recovery of the amount in case the decision of PCAT is reversed in the appeal.'   Read More

CHQ writes to CMD requesting Reduction of hard tenure period from 2 year to 1.5 year for Udhampur and Rajouri SSAs in J&K circle:

'Stations in Udhampur and Rajouri SSAs are far flung and their topology is typical and totally mountainous and sliding area. Executives coming on transfer from other circles find it difficult to cope up with the adverse climatic conditions which include heavy rains, storms, road blockage, no-air connectivity for emergency and high level militancy.Two years is practically a very long period to cope-up with in these SSAs.'  Read More

CHQ writes to CMD regarding Promotion to Executive Engineer grade in civil/ Electrical/ Architect streams:

'Our observation still holds good. We therefore request you to kindly examine our request for diversion of MT quota posts to seniority quota in Civil, Electrical and Architect streams. Meanwhile CPC for promotion to STS grade in Civil, Electrical and Architect wings may be caused to be held immediately for the existing vacancies. Once a decision is taken for diversion of MT quota vacancies to seniority quota, another CPC may be held without further delay.'  Read More

CHQ writes to Chairman Committee on CPSU cadre hierarchy and two other issues:

'When the revised pay scales were implemented for BSNL Executives on the basis of Government decisions on Second PRC, E6 scale was not offered to any cadre/grade in BSNL. AIBSNLOA had therefore suggested “review of the issue dispassionately and grant of following IDA pay scales to the Executives from JTOs level to Dy GMs : (a) JTOs level : E-2 scale, (b) SDEs level : E-3 scale, (c) Sr SDEs/Sr AOs : E-4 scale, (d) DEs level : E-5 scale and (e) DGMs level : E-6 scale.'...'Had E6 scale been given to JAG grade, SG JAG grade would have got E7 scale. Today, a discrepancy exists wherein Group B absorbees are fitted in E6 scale for SG JAG, while those absorbed as Group A have been given E7 scale for SG JAG.'...'Finally, it is learnt that, there is an indication by the Management side that resolving of these issues may not be retrospective in nature. We are in complete disagreement with such a notion since, at the time of pay revision w.e.f. 1.1.2007, BSNL orders dated 5.3.2009, while tabulating revised pay scales effective from 01.01.2007 for other cadres, did not mention any pay scale for the pre-revised scales of 9850-250-14600 (E1 A) and 11875-300-17275 (E2A) for JTOs and SDEs and equivalent cadres, but left a foot note that revised IDA scales for E1 A and E2 A will be notified later. Therefore, any revised scale that will be decided now should be effective from 1.1.2007 only. Denial of arrears will be against all norms and legal prudence since it is BSNL who delayed the notification unduly for more than six years and the executives cannot be allowed to suffer on this count.' 'We learn that in Kolkata Telephones, 5O candidates appeared in the LICE held on 2.6.2013. Results were declared in respect of 23 candidates with no one scoring the minimum qualifying marks. Results of 27 candidates who were allowed to sit for the examination were withheld. Therefore the 216 vacancies under department quota remain unfilled, when there is acute shortage of JTos in the field.'  Read More

'The primary condition for use of any electronic device for recording the vote of the Executive should be that, such voting should be conducted in a controlled environment of specified date, time and place, under supervision by senior level officers or an outslde agency, so as to address the concerns about secrecy of the vote, group voting, intimidation, compulslon and diktat from controlllng officers. Voting in uncontrolled environment like voting from office or home through personal computer, voting through mobile or any common device and recording the votes on different dates and times cannot be accepted on any account. It has taken more than a year and a half for DoT to get a recommendation by a GoM for refund of Rs 6,724.51 crore. 'These guidelines are clear violation of the DoP&AR O.M. No. No.1/3/69-Estt(D) dated 22nd November, 1975 stipulating the Policy to be followed in case where persons refuse promotion to a higher grade.
